Welcome to With Jeej. These Terms of Service set forth the terms and conditions that apply to your access and use of www.withjeej.com, our WooCommerce store at www.withjeej.com/shop, and your engagement with our services (collectively, the “Services”). Please review the following terms carefully. If you do not agree to these terms, you may not access or use the Services.

These terms of service contain a class action waiver, jury waiver, and an agreement to resolve any dispute that may arise by arbitration. The term “With Jeej” or “us” or “we” or “our” refer to With Jeej, the owner of the Services. The terms “you” or “your” refer to the user or viewer of the Services.

In order to make the website, products and services available to you, we are required to process your personal data. With Jeej is committed to keeping your personal data secure. Please read With Jeej’s privacy policy carefully, which can be found at https://www.withjeej.com/privacy-policy/ and which is applicable to you when using With Jeej’s website, subscribing to newsletters or news updates or mailing lists and when buying products and/or services from With Jeej.

Any new features or tools which are added to the current store shall also be subject to the terms of service. you can review the most current version of the terms of service at any time on this page. We reserve the right to update, change or replace any part of these terms of service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

  1. Acceptance 

You agree to the terms and conditions set forth in these Terms of Service (the “Terms of Service”). These Terms of Services are the only agreement between us and you and supersede all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Services, the content, products or services provided by or through the Services, and the subject matter of these Terms of Service. You must be at least the age of legal majority where you live (which is currently 18 years old in most states) to use our services, or you must have the permission of your parent or guardian who must agree to these terms on your behalf.

  1. Use of Services and/or Products

Certain sections of, or offerings from, the services and products may require you to register. If registration is requested, you agree to provide us with accurate, complete registration information. We do not permit (a) any other person using the registered sections under your name; or (b) access through a single name being made available to multiple users on a network. You are responsible for preventing such unauthorized use.

With Jeej offers a wide range of items for sale in-studio and through the website. With Jeej may at its sole discretion change, remove, add items offered and at its sole discretion determine the validity and conditions of an offer. Once you proceed with the order, you agree to and acknowledge the exception on your right of withdrawal. For instance, some products are non-refundable and/or non-returnable and will be labeled as such in the webshop. Should you choose to purchase a non-refundable and/or non-returnable item, by selecting such item and proceeding to checkout, You have accepted the restriction of your withdrawal right pertaining to such item.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the terms will result in an immediate termination of your services.

  1. Types of items With Jeej offers:
    • Original artworks: artwork including but not limited to sculptures, paintings & editions.
    • Limited editions: Limited edition items including but not limited to artworks, collectibles, clothing, will only be available for a limited period of time or until the batch has been sold.
  1. General terms items

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our return policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.

As soon as the shipment has left the Netherlands, all risks of transport should be dealt with by the buyer of the artwork. All content in the artworks are not real substances or real products, and all inside is legal.

  1. Availability 

Even though we use our best efforts to keep the information on the website accurate and up-to-date, You acknowledge that the website may not always reflect the current availability of the items. Upon visiting the studio, customers will see an impression of previous items produced by Jeej. Customers understand that some items may no longer be available for purchase. Both the items displayed on the website or in the Studio are merely an indication of items With Jeej may be able to produce and/or offer for sale, however, customer understand that the availability of an item or the possibility to produce an item must be verified through Jeej on an ad hoc basis.

With Jeej strives for continuous innovation and creativity and may as such test in the market a potential new item. In the event a potential new item does not receive sufficient potential customers, With Jeej may choose not to take the item into production and will as such not become available for purchase.

  1. Modifications to the service and prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service.

  1. Placing, Acceptance and Canceling an order

7.1. Placing an Order

With Jeej offers a range of items for sale via among others the website, in the studio, in person to you. You may request an offer, amend and place an order through email, telephone, via the website or in the studio. An offer made to you by With Jeej in the studio or by phone or email, is valid for 5 business days unless otherwise confirmed by With Jeej. An offer made on the website is valid as long as indicated on the website. The offer will automatically lapse after the aforementioned period and With Jeej  is not obliged to make a new offer on the same terms and conditions. If an offer is not followed up by a customer with an order, no purchase option has been established for the customer and With Jeej has no obligations towards the customer. An order is merely a request to purchase an item. Upon placement of the order you have payment obligation which has to be fulfilled directly when purchasing via the website or within 14 days if purchasing directly or in the studio. If you do not fulfill your payment obligation, With Jeej reserves the right to cancel your order. If your order was accepted, you will receive a written receipt of your order with a summary of the order and a description of the ordered items. The order will be delivered to you to conform the order confirmation. The sales agreement between you and With Jeej has been established on the time and date as indicated in the order confirmation, which you will receive upon shipment of your ordered items. 

7.2 Acceptance of an order

Before placing an order, the customer can change and correct the details of the desired order at all times. Once you have selected your desired Items, you can choose the quantity and any applicable options. You can review and correct, if necessary, any items added to your online shopping cart. When ordering customized or special items, the customer is responsible for providing all correct information such as sizing, color options. Any errors in the provided information by the customer are solely the customer’s liability. Always review your shopping cart before proceeding to check-out. Once you click place order and pay, your order is placed. You now have an obligation to pay the amount due as described in your order summary. After your submission of the order, With Jeej will process your order and if accepted, you will receive an order confirmation. The sales agreement between you and With Jeej has been established on the time and date as indicated in the order confirmation. The order will be delivered to you conform the order confirmation.

7.3 Canceling or refusal of an order

If we are unable to accept your order for any reason or the items in your order cannot be delivered as requested, we will notify you by email. With Jeej reserves the right to limit the gross value of an order via the website and to limit the maximum order quantity of items per type. In case your order has been refused by With Jeej, you will not receive an order confirmation and no sales agreement between you and us has been established.

When ordering from the website, you may cancel your order as long as you did not receive an order confirmation. You will receive a full refund of the purchase price within 30 days into the customer’s bank account corresponding with the bank account used to place the order. In the event we cancel your order, you will receive a full refund of the purchase price and shipping costs charged to you within 10 days into the customer’s bank account corresponding with the bank account used to place the order. For an in-studio purchase, it is not possible to cancel your order, unless payment has not been made yet by the customer.

Customers are not allowed to cancel an order for an original artwork once With Jeej has commenced production on such original artwork. Customers are obliged to purchase such original artwork.

You may also exercise your right of withdrawal within 14 days as instructed under Article 8 TC, unless any of the restrictions of your withdrawal right applies. With Jeej doesn’t buy back any artworks from customers.

With Jeej may cancel your order in the event:

  • With Jeej discovers an obvious and undeniable error in the purchase price or description of the item; 
  • Your payment cannot be authorized.
  • With Jeej suspects fraudulent activity or suspects you are a professional buyer and you have not identified yourself as such before ordering;
  • The Item is unavailable, discontinued, out of stock; 
  • The customer was not eligible to order according to these TC

Any other event as reasonably determined at its sole discretion by With Jeej. With Jeej will notify you by email in the event the order has been canceled by With Jeej.

  1. Pre-registrations 

We may provide pre-registration for new items and limited edition items. The customer understands that pre-registration does not include the right to purchase the limited edition item. Customers who wish to purchase the limited edition item will be chosen at random by Jeej. A link for the down payment will be sent to the customer once they select it. You will not be able to purchase the limited edition product at this time if you have not received a down payment link; however, you can re-enter pre-registration for another limited edition product.

Within 10 business days, you will receive a full refund of the payment if you were not selected and payment was required to reserve a slot.

  1. Payments, Ownership and Costs

9.1 Payments

The following methods of payment are accepted by payment terms With Jeej: iDeal, bank transfer, cash, credit card, debit card, or PayPal; however, PayPal reserves the right to make individual exceptions at its discretion. The invoice contains instructions and payment information. A third-party payment processor handles all payments. With Jeej has no control over the terms and conditions, privacy policies, or other legal documents used by this third party, which the customer acknowledges. The total price of the item is inclusive of all payment-related fees.

Upon acceptance of the order, the customer will be informed of the payment terms for in-studio purchases. The customer is obligated to pay the amount due during the order process for purchases made through the website. The customer agrees to receive invoices electronically. The order process will be canceled if the (online) payment process is unable to be completed for any reason. You are in default without the need for additional notice if you fail to pay after the sale has ended and your order has been confirmed. In the event of non-payment, With Jeej reserves the right to employ a debt collector and pursue additional legal action.

9.2 Ownership

Retention of ownership and title regardless of whether the aforementioned items are already in your possession, With Jeej remains the sole and legal owner of the items until the full payment of the purchase price is received in the designated bank account. The customer promises to treat any items not paid for in full with the utmost care and that they will be returned to With Jeej in accordance with the company’s return policy. The legal title to the Items immediately passes to With Jeej in the event that the agreement is terminated.

9.3 Costs

Taxes, additional costs, and shipping costs will all be mentioned separately before the order is placed for products that are not fragile. After an order has been placed, With Jeej reserves the right to charge additional fees for shipping and custom crates for fragile items. Before With Jeej accepts and confirms the order, the customer will be provided with an estimate of these additional costs. If required by law, With Jeej may charge customers additional taxes, and the customer will be informed of these costs before the order is confirmed.

When shipping outside of the Netherlands, the customer is solely responsible for paying any applicable import taxes. Before placing an order with us, we advise you to verify your import laws and regulations.

  1. Delivery or Order Pick-up

10.1 Delivery

Within five business days of the order confirmation date, With Jeej can deliver in-stock non-fragile items. For all fragile items, With Jeej’s estimated delivery times are only a guide. Given the nature of the item, such as artwork, the customer acknowledges that the reasonable delivery time is determined by the production process and the availability of materials. If the expected delivery time cannot be met, With Jeej will let you know and work with you to set a new time. You acknowledge and agree that you are not entitled to damages or to terminate the sales agreement if you fail to meet the estimated delivery time.

Unless otherwise specified, purchased items will be delivered to the address specified in your order confirmation. Any customized, commissioned, framed, or fragile products will have a delivery estimate provided by customer service. When the items have been handed over to the shipping service, With Jeej will send an email to the customer with information about the dispatch and the anticipated time of delivery. If the delivered order, as described in the Order Confirmation, is incomplete or incorrect, With Jeej will endeavor to contact you within the next 48 hours to resolve the issue.

Costs and shipping options 
With Jeej will ship all non-fragile items via parcel post at the standard rates of Dutch Post.nl. With Jeej will let you know how much shipping will cost before the order is placed. The customer or a designated third party accepts full responsibility for the products when the order is delivered to them. The customer is responsible for shipping fragile items from the studio to the customer’s delivery address. The customer is obligated to adequately insure the items during their transportation. Shipping instructions will be provided by With Jeej. If the customer so requests, Jeej will inform them prior to placing an order of the shipping costs and any additional costs, such as the cost of packaging fragile items. A crate made just for you can be used to ship fragile items like artwork. With Jeej can select the shipper and will adequately guarantee delivery from the studio to the customer’s address. Jeej ships only ex works, which means that the shipper is entirely responsible for the shipment.

10.2 Order Pick-up 

Fragile items can be picked up from the studio by the customer or a professional shipper. After you have paid the entire purchase price, customer service will get in touch with you to set up a time for you to pick up your purchased items. At the time of pick-up at the studio, you or the designated recipient must sign a number of documents confirming acceptance of the items in their current known condition. When the customer signs the pick-up agreement, they agree to bear all risk and liability. The client vows to deal with sufficient delivery and protection for the thing’s worth.

When the item is picked up at the studio by a professional shipper of the customer’s choice, a pick-up document must be signed. When they sign the pick-up agreement, the shipper takes on all risk and responsibility. The client vows to deal with satisfactory transportation and protection for the thing’s worth.

Damage sustained during shipment, which was arranged by With Jeej

If the purchased items are damaged during transportation to the location of delivery for reasons other than With Jeej’s negligence or omissions, the customer has the option of returning the shipment for a refund or, if possible, choosing a replacement item from a similar series of items. If an item is replaced, customer service will let you know when it will arrive. The customer acknowledges that no two items are ever exactly alike.

Customer-arranged shipping

Fragile items that are shipped by a customer-hired third party are the customer’s sole responsibility and are shipped at their own risk if the customer arranges for their shipment. If an item is damaged during transportation to the delivery location, Jeej is not obligated to replace or refund it.

  1. Certificate of Authenticity

With Jeej will send you a signed Certificate of Authenticity upon demand. Please be aware that With Jeej cannot guarantee the authenticity of merchandise and artwork purchased from galleries not affiliated with this website.

  1. Installation of an Artwork

With Jeej will coordinate and make plans for the artwork’s installation if the customer asks. With Jeej merely arranges installation as a service to the customer, and the customer acknowledges that With Jeej is not liable for any damages to the customer’s belongings unless With Jeej is grossly negligent and/or omitted, in which case any damages payable will be limited to the purchase price of the artwork. The customer acknowledges that the artist will not attend the installation unless specifically requested to do so by the artist and at his sole discretion. The customer is obligated to request installation instructions from With Jeej and to follow them if the customer arranges for the installation of a fragile item like an artwork.

AFTER SALES

  1. Caring for your Artwork or Product 

We urge you to handle an expensive and fragile piece of art with extreme caution because you have purchased it. Unless the artwork has been explicitly constructed in such a manner by With Jeej, it is not permitted to be displayed outdoors or in an environment that deviates from the norms outlined in sub-paragraph (g) below. This includes the fact that the artwork cannot be touched because doing so will accelerate wear. The artwork itself will determine appropriate handling, installation, and care. In order to preserve your artwork, we have provided a number of guidelines for you to consider below. If you have any questions, please contact our customer service. With Jeej may assume that the customer will comply with any guidelines not specifically mentioned below by making reasonable efforts and applying common sense.

You may lose your right to a guarantee or repair if you do not follow the guidelines below. With Jeej is authorized to charge repair costs if the artwork can be repaired. The customer must be able to demonstrate compliance with the following instructions.

a. Handling the Artwork

Wear gloves if at all possible and make sure your hands are clean. Make sure to have a few skilled individuals available for heavy and bulky artwork. When handling the artwork, don’t wear any jewelry or carry any sharp objects. Before moving the artwork, check the framing and always carry it with both hands on either side of the frame. Check the artwork before putting it down or resting it on any surface. It is never allowed to use force with a blunt object.

b. Following installation instructions for the Artwork

The customer will go back to With Jeej for instructions on how to install. The customer will also be informed about suitable equipment and preferred personnel. If the customer disregards With Jeej’s instructions, the company will not be obligated to repair the artwork or compensate the customer for any damages. The customer is obligated to acquire appropriate equipment in the event that an artwork cannot be reasonably carried by one person.

c. Use of qualified personnel during the installation of the Artwork.

The customer is responsible for hiring competent labor to install the artwork.

d. Hanging the Artwork

Find a level, stable, and solid surface by checking the wall. To hang the artwork, make use of appropriate, long-lasting, and sturdy hardware. For stability and balance, use wall anchors, braces, and double wires for heavy artwork. Make sure that no anchors, hooks, or wire touches the canvas or any other delicate areas that are exposed. Periodically check the condition of the metals and other devices used to hang the artwork.

e. Things to consider at all times:

  • Use utmost care when allowing children and/or pets around the artwork.
  • Weather and climate related circumstances which may influence your artwork. 
  • Don’t hang or place the artwork near a heat source. 
  • Don’t hang or place the artwork in an unstable place. 
  • Control the room’s humidity and temperature.
  • Don’t hang or place the artwork in direct sunlight.
  • Avoid water damage to the artwork at all times.
  • Only dust off your artwork with specialized soft cloths, do not use detergent or any cleaning agents or hard, metal, rough surfaces.

f. Clothing

Clothing: Only by hand should all clothing be washed and dried.

g. With regards to the placement of the Artwork indoor environment, the following norms should be considered:

  • Temperature: 17-30 C
  • Relative humidity: 45% with allowed fluctuations of + 10% or -10%
  1. Non-conformity 

14.1 Acceptance of the order

Performing an immediate inspection upon delivery, customers are not permitted to use or wear products like books, jewelry, or clothing. With Jeej reserves the right to deny a return or refund of a product that has been worn or used. After inspecting the artwork, both the customer and With Jeej will sign an acceptance form if the customer chooses to pick up an item from the studio. The artwork can be shipped once the customer accepts the order.

Prior to full acceptance of the artwork, the customer cannot install or display it after it has been delivered. If customer service does not receive a written notice of nonconformity within 24 hours of delivery to you, the delivered artwork will be considered fully accepted by the customer. The customer may accept the artwork if it reveals an acceptable error.

Given the nature of an artwork, the piece or pieces will be replaced if they reveal an error that is unacceptable. When it comes to a Limited Edition, the customer acknowledges and agrees that the replacement will not be the same piece of art or the same number.

If the customer does not notify With Jeej within 24 hours of any defects or damages to the delivered item, the item will be accepted and With Jeej will assume that the damage occurred while the item was in the customer’s possession. As a result, the customer will be billed for any costs associated with repairs.

14.2 Detected non-conformity

If the non-conformity is discovered by the customer within two (2) months of the deficiency’s discovery, With Jeej may request a comprehensive description, photographs, or other evidence of the defect. If the artwork and/or product delivered by With Jeej to the customer does not conform, With Jeej will fix it for free or, if that is not possible, replace the artwork and/or product. Customers may request a full refund of the purchase price, including the original shipping costs, if the customer provides the original shipping cost receipt or with Jeej, and the customer will make every effort to find a reasonable solution if a repair or replacement is not possible due to the nature of the items. The customer is responsible for adequately covering the Artwork(s) being returned to With Jeej. With Jeej will pay for insurance after receiving the insurance note.

In accordance with our return policy, items deemed non-conforming must be returned to With Jeej immediately. The risk of transporting the returned items to With Jeej is the responsibility of the customer. The customer will not receive a complete refund of the purchase price if the returned items are damaged, incomplete, altered, discolored, or otherwise defective. In that case, Customer Service will get in touch with you to let you know what’s left of the refund.

14.3 Non-conformity of parts provided by third parties

In the event part of an Item produced by a third party, With Jeej will assist customer in providing a suitable but reasonable solution.

14.4. No non-conformity

Any damage caused by the customer is not considered non-conformity if the customer creates a situation or fails to follow the instructions or guidelines provided by With Jeej regarding, among other things, the shipment, installation, or care of the artwork.

Artworks are living things that will naturally age. This process of aging is not regarded as non-conformity.

  1. Right of Withdrawl 

Purchases made online (via phone, email, Whatsapp, and website): Unless otherwise specified for a specific item, the customer has fourteen (14) days from the date of delivery to revoke the agreement with With Jeej without giving any reasons. You must make a clear statement to us (for example, via email, fax, or letter) that you want to exercise your right to withdraw from this contract in order to do so. It is sufficient for you to send your communication regarding your exercise of the right of withdrawal prior to the expiration of the withdrawal period in order to meet the withdrawal deadline. When returning the items to us, please follow the instructions. After revoking the sales agreement, the customer is responsible for paying for the return of the entire order to With Jeej.

Purchases made in person at the studio: It is not possible to withdraw the purchase. With Jeej does not purchase back artworks. Please be aware that any items purchased from a third-party gallery are subject to those gallery’s terms and conditions.

15.1 The right of withdrawal does not apply to the following items:

The following Items may not be returned under the right of withdrawal:

  • Personalised and/or signed Items;
  • Original Artworks which have produced upon request of the customer;
  • Commissioned Items;
  • Sealed Items which were unsealed after delivery and unsuitable for return and re-sale to another customer according to With Jeej;
  • Any other Items made to the consumer’s specifications;
  • Non-refundable Items, which were labelled as such on the website.
  • The above Items are non-returnable and non-refundable.
  1. Return Policy for Online Purchaces or by Telephone

We can only accept returns on purchases made directly through Our Website from With Jeej. Please get in touch with your gallery if you purchased an item or work of art from a different gallery. With Jeej is not obligated to accommodate your request for withdrawal if you purchased an item from a third party.

Within 14 days of the date your Sales Agreement was cancelled, please return the purchased items, including the box and all original packaging. The customer must be able to demonstrate that the items were returned within the 14-day deadline. To prevent damage during transport, all returned items must be adequately packed. Please contact customer service to inquire about adequate insurance and packing instructions if you are returning fragile items. Please be aware that the customer is in charge of the shipment until With Jeej receives the returned item in the studio.

The customer must be able to provide written evidence (track and trace, freight letters, etc.) of the cost of shipping the returned items to With Jeej via a reputable carrier. The customer must demonstrate that the item was returned correctly if With Jeej has not received it, and With Jeej will choose the best course of action at its sole discretion. If a returned item is damaged during transportation, Jeej reserves the right to charge for repairs.

  1. Effects of Withdrawl and Refund Policy 

All ordered items must be returned to With Jeej in order for a refund to be considered. If With Jeej finds that the items that have been returned are in good condition, the customer will receive a full refund of the purchase price, as well as the cost of the original shipping and any additional fees that may have been incurred, provided that the items have been returned to us in their original condition, which means that they have not been altered, damaged, incomplete, discolored, or have any other defects.

The customer’s bank account that corresponds to the one used to place the order will receive the refund. We reserve the right to deny a refund, reduce reimbursement for shipping costs, or charge for repairs if the item(s) being returned have lost value or been damaged.

17.1 Guarantee and Repairs
            1. Guarantee

Considering that Items are properly used as intended by the Customer, Customer is granted a two (2) year warranty on Artworks and/or Products purchased.

            2. Repair

With Jeej may, at its sole discretion, charge a fee for repairing a damaged item in the event of negligence, intentional damage, lack of proper care, discarding shipping and/or installation instructions, or inadequate equipment or personnel instructions. The customer agrees and acknowledges that repairs may not be possible if the materials, methods, or other procedures required for them are no longer available to With Jeej. The customer can request a quote from Jeej for the necessary repair for items purchased on the secondary market. Jeej reserves the right to charge a market-conforming fee for repairs and may, at its sole discretion, determine whether an artwork can be repaired. The customer is responsible for returning and shipping the artwork to With Jeej if it cannot be repaired. The customer will pack the artwork appropriately, pay for shipping, and insure it for the same amount as the value shipped. With Jeej may reimburse shipping costs at its sole discretion. The repair of a Limited Edition piece of art may necessitate the replacement of the piece with one from a different series, which the customer acknowledges and accepts. A third-party supplier supplies any component of an artwork or product, including, but not limited to, frames. You will receive the guarantee and repair policy from Jeej from the supplier.

  1. General Intellectual Property Rights 

            1. Our rights

All intellectual property rights, including but not limited to trademark rights, copyright, neighboring rights, industrial design, trade secrets, title, and interest vested in all Artworks, Products, information, and content on the website are owned solely by With Jeej.

            2. Your rights: sharing on your social media

We must safeguard our intellectual property rights, as you will understand. You agree to treat With Jeej’s intellectual property rights with respect. The website is granted to you as a non-exclusive, non-sublicensable license. We also know that you enjoy posting pictures of the works of art on your own social media channels. You are welcome to do so; however, we would appreciate it if you would tag us and use the hashtags #jeej and #withjeej.

            3. Prohibited actions

You are not allowed to publish or reproduce anything, including but not limited to: to modify, duplicate, publish, adapt, copy, sell, offer, and make available the website, products, and/or artworks’ content and/or source code in any form. You agree to completely indemnify Jeej and/or the artist, as defined in art, and to hold With Jeej.

  1. Indemnification and Liability Website

You agree to indemnify and hold harmless With Jeej, the Artist, its affiliates, and their respective directors, officers, employees, agents, and representatives from and against any claims, fines, losses, penalties, and other expenses, including attorney’s fees, resulting from your use or misuse of the website by you or through your account, access to the website’s content, violation of these Terms and Conditions, or infringement of (third-party’s) rights, unlawful acts, in connection with this agreement or the sales whether the agreement or the sales agreement is terminated, this indemnity agreement continues in effect.

            2. Limitation of liability

With Jeej is not obligated to monitor the absence of viruses, worms, or any other threats to your devices because of your access to the website. It is entirely up to you to ensure that your devices or systems are adequately secured and to safeguard yourself against fraud, damages, harmful computer programs, and other harmful content. When users use the Website or third-party websites accessed through the Website, Jeej assumes no liability for any harm to their computers or software. To the fullest extent permitted by law, With Jeej shall not be liable to Customer for any loss (including but not limited to loss of profits or revenues, or any loss of data, use, or other intangible losses) or damages (including but not limited to incidental, special, consequential, or punitive damages to belongings and/or persons, damages caused by parts of Items produced or provided by third parties):

a result of any kind of interruption, inaccessibility, cancellation, or suspension of the website that is brought on by or incurred as a result of disconnections in telecommunication services or website maintenance. In no event is Jeej responsible for indirect or consequential damages, missed savings, lost profits, or business interruption damages;

  • Caused by any conduct or content of any third-party on the services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties;
  • Caused by unauthorized access, use or alteration of your transmissions or content.
  • not a result from With Jeej ’s negligent acts or omission or wilful misconduct;
  • not caused by With Jeej’s breach of these TC;

is caused by a reasonably unforeseeable event beyond With Jeej ’s control and which prevents With Jeej from fulfilling its obligations under the Agreement and/or Sales Agreement. With Jeej’s total liability for any loss or damage resulting from or connected to this Agreement or the Sales Agreement shall not exceed the order’s total value. Any theory of liability—warranty, contract, statute, tort (including negligence), or otherwise—is subject to the restrictions outlined in this subsection, even if a remedy provided herein is found to have failed of its essential purpose. With Jeej’s legal representatives, employees, and agents are covered by these limitations of liability even if the agreement or sales agreement is terminated.

            3. Force Majeure

In the event of a Force Majeure event, Jeej shall not be liable for any breach of its obligations under this Agreement and/or Sales Agreement. You may immediately terminate Your Agreement and/or Sales Agreement by sending a written notice to hello@jwithjeej.com if an event of Force Majeure continues for at least three (3) months.

Any notice or other formal communication to be given under this Agreement shall be, in order to be effective, in writing (which may include e-mail), signed by You, and may be served by leaving it or sending it to:

Any notice or other formal communication sent via the methods indicated below are considered to have been received by the addressees at the following moments, if sent by:

  • registered letter: on the date stated on the proof of receipt; 
  • courier: at the moment of issue to the addressee by the courier; 
  • email of which the receipt is automatically confirmed: on the date on which the confirmation has been sent.
  1. Miscellaneous

The details of the sales agreement will never be disclosed to the customer. Compliance with all applicable tax laws, rules, and requirements will fall on With Jeej and the customer. With Jeej, promotions, contests, and sweepstakes may occasionally be organized. Please read the rules for these promotions, contests, and sweepstakes. Customer’s actions will not in any way harm, corrupt, denigrate, defame, libele, slander, destroy, or diminish With Jeej’s reputation or goodwill. Even if any of these terms and conditions are found to be invalid, unenforceable, or ineffective, you are still bound by them all. You will at least agree to accept the same effect as the invalid, unenforceable, or non-binding provision in the event that it is enforced to the fullest extent permitted by applicable law, given the terms and intent of these terms and conditions. Neither With Jeej nor either party’s waiver of a breach of any provision of this Agreement does not permanently modify or waive any subsequent breach.

  1. Trademarks

All names, logos, product and service names, designs, and slogans are trademarks of With Jeej or their affiliates and licensors. You must not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify such marks without the prior written permission of With Jeej. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.
